IMPLEMENTATION OF THE INDIVIDUAL GRIEVANCES REGULATIONS IN THE DOD

The Minister of Defence and Military Veterans, the Honourable Ms (Dr) Lindiwe Nonceba Sisulu, has promulgated the Individual Grievances Regulations in the Government Gazette for implementation with effect from 01 July 2010. These Regulations were published in Government Gazette No 33334 on 30 June 2010 and are available on the DOD Policy website.

NEW GRIEVANCE PROCEDURE

The Regulations give effect to the Individual Grievances Procedure which is a single procedure for both uniformed members and PSAP in the DOD. It is a three tier process where the grievance is addressed by the following levels, if necessary:

  • Unit
  • Service/Division (Formation if so design-nated)
  • Secretary for Defence/C SANDF/MOD

The Individual Grievances Regulations are vertically and horizontally aligned with the relevant legislation. They accommodate the needs of Service and Division specific requirements. They are user friendly and understandable to ensure that grievances are handled within the pre-scribed timeframes, and address control and acc-ountability as well as non-compliance. The Regula-tions are easily accessible to all DOD officials.

SUPPORT

A Grievance IT System has been developed as a component of the Action Request System (ARS). This system will be made available to identified users of the system to support the individual grievances pro-cedure electronically. The system will be implemented by 16 July 2010 to lodge, update, track and monitor the status of grievances. Representatives at Services and Divisions have already been trained with the view to training other users of the system.

These Regulations will be fully supported by a DODI; however, for the interim an Instruction will be issued for the implementation of this new procedure. The Impl-ementation Instruction and the training manual will be available on the HR website during the week of 5 July 2010.

Training on how to lodge a grievance and the responsibilities of the various role- players will be conducted by means of training DVDs, the Instruction, the Intranet and a road show by DLSR. Training DVDs will be distributed to every unit via the Labour Relations Offices in due course and will be available to any individual who may require advice on the process of lodging or addressing a grievance.

An aggrieved person will then be the driver of his/her own grievance in accordance with the provisions of the Regulations.
